If a room is ordered and confirmed or, in the case of short-term bookings, made available, an accommodation contract has been concluded.
A legally binding contract is also made for verbal bookings, especially bookings made by telephone, unless expressly agreed in writing.
The conclusion of the accommodation contract obliges both contracting parties to fulfill the contract, regardless of the duration of the contract.

The owner of the accommodation facility is obliged to provide the booked accommodation for the agreed period.

The guest has to pay the accommodation price as contractually agreed.
A unilateral, free cancellation on the part of the guest from a binding booking is fundamentally excluded
if the guest cannot use the booked accommodation for reasons that are in his risk sphere (exception: force majeure).
If the guest withdraws from the contract anyway, he is obliged to pay the agreed or customary price regardless of the time and reason for the withdrawal.

The owner of the accommodation establishment must, however, have saved expenses offset against his entitlement.

According to the case law, the value of the saved expenses for an overnight stay with breakfast is a flat rate of 20%,
for an overnight stay with half board a flat rate of 30%, for an overnight stay with full board a flat rate of 40%
and for renting a holiday apartment or a holiday home a flat rate of 10% of the accommodation price accepted.
The owner of the accommodation establishment is required in good faith to rent an unused accommodation to someone else
and must deduct the saved accommodation against the cancellation fee claimed by him.
The guest reserves the right to prove that the accommodation establishment suffered no or significantly less damage.
The owner of the accommodation establishment must pay compensation to the guest
if the accommodation booked is not provided for which he is responsible (e.g. due to overbooking). Only in cases of force majeure, such as natural disasters,
is the owner of the accommodation facility released from the service.

Free cancellation is possible until 21 days before arrival.
